UPON hearing the counsel the Court made the following O R D E R

The petitioner was granted three months' time to vacate the premises on 21.10.2021, subject to filing an undertaking by way of The undertaking was furnished with a delay, but by an affidavit. that time the application seeking condonation of delay came up for hearing, three months' time had expired. The learned counsel for and convert petitioner sought time to find out as to whether the petitioner ally signed by 10.27 AND actually vacated the premises or not.

Today, the learned counsel for the petitioner has informed the Court that house is still in lock and key of the petitioner, though he has removed the goods.

We find that the petitioner is taking advantage of the fact that the date fixed before the Executing Court for further proceedings is 23.02.2022.

We find that the petitioner has violated the undertaking given to this Court. Therefore, we call upon the petitioner through his counsel to appear before this Court on 16.02.2022 physically to explain as to why he should not be punished for violation of the undertaking given to this Court.

List on 16.02.2022.

The Registry shall allow the petitioner to appear before the Court physically.
