UPON hearing counsel the Court made the following O R D E R

In both the cases, it was recorded by order dated 7.10.13 respondent No.1 had appeared and was granted time. However, Mr. Promod Dayal submits that it is respondent No.32 who had filed caveat and had appeared on that day. Hence, the order dated 7.10.13 to that extent stands modified. Respondent No.32 is granted time in both the cases to file their respective counter affidavit.

It is submitted on behalf of respondent No.9 in SLP(C) No.24131/12 that respondent No.9 has died and the details of the Lrs. have been furnished to the Ld.counsel for the petitioner. It is further submitted that the details regarding the date of death will also be furnished in the course of time.

In SLP(C) No.23953/13 Ld.counsel for the petitioner seeks dasti. Permitted. Issue dasti.

Ld.counsel further submits that in SLP(C) No.24131/12 dasti was attempted and it was reported that some of the respondents have died. On the basis of the return of dasti received in both the cases, file appropriate application to take steps against the unserved respondents and also to bring on record the lrs. of deceased respondents. Time is granted.

List the matter on 9.01.2014.
