Permission to file appeal is granted.

The learned senior counsel appearing for the appellants submits that the present appellants who have approached this Court established their Coke Plants, after seeking all statutory compliances and after seeking no objection from the respective authorities, and much prior to the notification dated 23.12.2020. Learned senior counsel further submits that the only grievance of the appellants is with reference to the 'location' and since each of them have located and established their Coke Plants after seeking prior permission from the State authorities, at least to this extent, the Notification dated 23.12.2020 may not come in their way and the observations made by the Tribunal in this regard needs to be examined by this Court.

Issue notice limited to the aspect of 'location', and on the application for stay, returnable on 12.12.2022.
