HON'BLE MR. JUSTICE DINESH MAHESHWARI HON'BLE MR. JUSTICE VIKRAM NATH

For Petitioner(s)Mr. Shailesh Madiyal, Adv.
Mr. Mahesh Thakur, AOR
Ms. Rakhi M, Adv.
Ms. Vipasha Singh, Adv.
Ms. Shailja Das, Adv.

For Respondent(s)

UPON hearing the counsel the Court made the following O R D E R Delay condoned.

Having heard the learned counsel for the petitioner and having perused the material placed on record, we are not persuaded to exercise the jurisdiction under Article 136 of the Constitution of India in this matter. Therefore, this petition is required to be dismissed. Digitally signed by Signature Not Verified

While dismissing this petition, we also deem it appropriate to indicate that the FIR in the present case was lodged way back on 24.07.2009 and the Trial Court dismissed the discharge application Date: 2022.01.05 17:26:53 IST Reason:

of the petitioner on 11.09.2015 and thereafter, the matter remained pending in the High Court before the High Court dismissed the Criminal Petition on 20.02.2019. Obviously, an excessive period has already elapsed since the filing of the charge sheet. In the given circumstances, we would expect the Trial Court to assign a reasonable priority to the matter and to proceed with the same expeditiously.

Subject to the observations foregoing, this petition stands dismissed.

All pending applications stand disposed of.

(SHRADDHA MISHRA) (RAM SUBHAG SINGH) SENIOR PERSONAL ASSISTANT BRANCH OFFICER
