UPON hearing counsel the Court made the following O R D E R

Perused office report dated 2.5.2013.

The affidavits have been filed by the Secretary, Ministry of Health and Family Welfare and Manipur Pollution Control Board in compliance of the directions given by the Court on 3.4.2013.

The State of West Bengal, the Administrator of Dadra and Nagar Haveli and Daman and Dieu, U.P. Pollution Control Board, Bihar Pollution Control Board, Secretary, Health Department, Karnataka , Central Pollution Control Board and State of Nagaland have also filed their respective affidavits.

Shri Ranjit Kumar, learned senior counsel appearing for the petitioners in some of the matters complains that copies of the affidavits have not been supplied to his instructing counsel.

Such of the Pollution Control Boards, Secretaries to the Governments and the Union Territories who have not filed the affidavits so far are allowed six weeks' further time to do so. It is made clear that those who will not file affidavits within the extended time shall do so at their own peril because the Court is bound to take serious adverse view of lapses on their part.

Learned counsel who have already filed affidavits are requested to supply copies thereof to all the contesting parties.

The Registry is directed to prepare a compilation of the affidavits on or before 25.06.2013 and supply copies thereof to the counsel who desire to obtain the copies.

List this and connected matters on 25.07.2013.

Keeping in view the importance of the issues involved in these petitions, we request Shri Gopal Subramanium, Senior Advocate, who had earlier assisted the Court in the capacity of Solicitor General, to now assist the Court as an amicus. Shri Subramanium who is present in the Court has graciously accepted the request of the Court.
