UPON hearing the counsel the Court made the following O R D E R

Respondent no.1 has already filed counter affidavit.

Despite due service on respondent nos.2, 3 and 5, there is no appearance.

Ld. Counsel for the petitioner submits that the court has directed to positively list the matter on 13.02.2024. Hence, appearing respondents i.e. respondent nos.6 and 7 are at liberty to file counter affidavit before 12.02.2024.

Ld. Counsel for the petitioner seeks for two days time to effect service upon respondent no.4.

List again on 12.02.2024.

Despite due service on respondent no.2, there is no appearance.

Ld. Counsel for the petitioner submits that the court has directed to positively list the matter on 13.02.2024. Hence, appearing respondents i.e. respondent nos.1, 4 and 5 are at liberty to file counter affidavit before 12.02.2024.

Application for substitution has been filed in respect of deceased respondent no.3. Same is defective. Ld. Counsel for the petitioner submits that he will cure the defects during course of the day. However, two days time, is granted to cure the defects.
