1 We have heard Mr Arvind P Datar, senior counsel appearing on behalf of the appellant and Mr Somasekhar Sundaram, counsel for the respondent.

2 It is common ground between the counsel that the decision of a two-Judge Bench of this Court in Civil Appeal No 563 of 2020 where judgment has been reserved, will have some bearing on the outcome of the present appeal. In order to await the decision in the above case, the present appeal shall be listed on 31 October 2022.
3 In the meantime, in order to obviate any delay in the completion of pleadings, notice shall issue.
4 Ms Pallavi Pratap, Advocate-on-Record appearing with Mr Somasekhar Sundaresan accepts notice on behalf of the first to third respondents.
5 Counter affidavit shall be filed within a period of four weeks. Rejoinder affidavit, if any, be filed within two weeks thereafter.
