UPON hearing the counsel the Court made the following O R D E R

Issue notice, returnable in the month of February, 2023.

In the meanwhile, there shall be stay of the directions given in the impugned order, subject to the appellant - Maharashtra State Electricity Distribution Company Limited depositing a sum of Rupees Thirty Crores within a period of four weeks from today with the Registry of this Court. The said deposit would be converted into an interest bearing Fixed Deposit Receipt for a period of six months with auto renewal clause.

In the meanwhile, the respondents will have the option to load/inject the energy/electricity generated by them in the grid. As an interim measure, the respondents would be paid for the energy/electricity put in the grid on the basis of the order passed by the Maharashtra Electricity Regulatory Commission (MERC). This interim arrangement is without prejudice to the rights and contentions of the parties.
