CIVIL APPELLATE JURISDICTION

I.A. Nos. 10-11 of 2016

IN

CIVIL APPEAL NO(s). 6169-6170 OF 2016

(Arising out of S.L.P. (C) Nos. 30110-30111 of 2015)

MAINAL MOLLAH APPELLANT(S)

VERSUS

UNION OF INDIA & ORS ETC RESPONDENT(S)

O R D E R

Delay condoned.

Leave granted.

Heard learned counsel for the parties and perused the impugned order.

The grievance of the appellant herein is that after show cause notice was served upon him, he had engaged a lawyer and prayed for time to submit written submission. Thereafter, as the appellant remained absent, without submitting the written statement, the order of deportation has been passed. Therefore, the appellant is before this Court.

Having regard to the nature of the impugned order, we feel that it would be just and necessary to give him one more opportunity for filing the written statement in the proceedings before the Tribunal within four weeks from today. We order accordingly.

The appellant must appear before the Tribunal on 29th August, 2016. Thereafter, the Tribunal will pass appropriate order in accordance with law after hearing the parties.

The appeals are disposed of in the aforesaid terms. The interlocutory applications also stand disposed of.
