O R D E R

• 1 These review petitions have been placed before me by way of circulation with two separate orders dated 31 August 2023. The first order dated 31 August 2023 is by His Lordship, Hon'ble Dr Dhananjaya Y Chandrachud, the Chief Justice of India, which reads thus:
  • "1 Delay condoned.
  • 2 Application for listing the Review Petitions in open Court is allowed. List the Review Petitions in open Court.

• 3 Issue notice returnable in four weeks.
• 4 Dasti service is permitted, in addition."
• 2 The second order is by Her Ladyship, Hon'ble Ms Justice Hima Kohli, which is also of the same date. The same reads as under:
  • "1 With respectful regards, I regret my inability to concur with the order passed by the Hon. Chief Justice of India for listing the Review Petitions for open court hearing and notice returnable.
  • 2 Having carefully examined the contents of the Review Petitions there is no valid reason to review the judgment dated 25th August, 2022 as in my view, the grounds taken in the review Petitions do not fall within the limited scope of review jurisdiction.
  • 3 The review petitions are dismissed as they lack merit."
• 3 Office has also submitted a report that Hon'ble Mr Justice Pamidighantam Sri Narasimha, who was the third member in the Bench, has since recused to take up the matter for personal reasons and, therefore, Hon'ble the Chief Justice of India has nominated me as the third member in the Bench.
• 4 I have perused the order under review and the review petitions.
• 5 Upon consideration of the materials on record, I am also of the view that delay in filing the review petition be condoned and the oral hearing of the review petition be allowed. Therefore, the delay in filing the review petition is condoned. Prayer for oral hearing of the review petition in open Court is allowed.

6 Let notice be issued returnable on 14 October 2024.
