Permission to file special leave petition(s) is granted.
Applications(s) for substitution are allowed subject to all just exceptions after condoning the delay and setting aside the abatement, if any.
Delay in filing and refiling the special leave petition(s), if any, is condoned.
Leave granted.
Heard learned counsel for the parties.
Although, separate Special Leave Petition(s) have been filed, these matters emanate from the common judgment and order dated 26.04.2019 passed by the High Court of Punjab and Haryana at Chandigarh, disposing of 108 connected appeals.
Those appeals pertained to two separate notifications issued by the competent authority for acquiring lands, referred to therein dated 10.07.2007 and 26.03.2008 respectively.
The High Court analyzed the matters concerning separate notifications independently.
Re.: First Notification dated 10.07.2007:
As regards the first notification dated 10.07.2007, the High Court relied on the sale instances cited by the claimants indicating that the market price for the lands in the
concerned area were ranging between Rs.60,00,000/- to Rs.63,50,000/- per acre; and, thus, fixed it at Rs.63,00,000/-. After providing 40 per cent deduction thereon, the High Court arrived at the fair market price at Rs.37,80,000/- per acre.
This computation by the High Court has been assailed both by the State as well as the claimants/land owners.
According to the State, the High Court ought to have relied on the sale instances produced by the State, which were of much lesser amount.
On the other hand, the claimants/land owners would urge that the deduction provided by the High Court on the exhibited sale instances is excessive, resulting in lowering of the market value of the subject lands drastically. The High Court has provided deduction of 40 per cent towards development costs.
As regards the view taken by the High Court in accepting the sale instances relied upon by the claimants/land owners, we find no tangible reason to deviate and discard the exemplars. The High Court had rightly relied on the sale instances which were in close proximity to the first notification and for reasons recorded in the impugned judgment, in particular, in paragraphs 32 to 36. We uphold that view of the High Court.
However, as regards deduction provided by the High Court to the extent of 40 per cent, we find the same to be excessive. The lands were in close proximity to the road and the town/city limits. Therefore, we accede to the submission made by the counsel for the claimants/land owners that the deduction should not, in the given facts, exceed one-third. In other words, the just deduction will be one-third of the market price determined by the High Court being Rs.63,00,000/ per acre. That deduction amount comes to Rs.21,00,000/- per acre.
Accordingly, the award in relation to the lands covered under the first notification stands modified taking the fair market price at Rs.42,00,000/- (Rupees Forty-Two Lakhs) per acre (i.e., Rs.63,00,000/- minus Rs.21,00,000/-). In addition, the claimants/land-owners would be entitled to other statutory benefits as awarded by the High Court.
In view of the above, the appeals filed by the State against enhancement are dismissed; and whereas, the appeals filed by the claimants/land-owners for enhancement are partly allowed in the above terms.
Needless to observe that this judgment will apply to all the claimants/land-owners covered under the first notification, whether party in the present proceedings or otherwise.
Re.: Second Notification dated 26.03.2008:
Reverting to the second notification, the High Court has determined the fair market price at Rs.31,50,000/-per acre. For doing so, it had relied upon the sale instances captured in the chart mentioned as Exhibits P-1, P-2, X-1, X-3, P-3, P-4, P-5, X-2, P-6, P-7 and P-8. However, the State is relying on the chart indicating the relied upon sale instances by the land owners being Exhibit Nos. P-1 to P-6. These instances pertain to lands situated outside municipal limits of villages Patti Jattan, Patti Shekhan, Patti Khekhan respectively. This chart has been reproduced in paragraph 27 of the Order dated 20.04.2013 passed by the learned Additional District Judge in the Reference proceedings.
It thus appears that the sale instances in respect of the first notification have been erroneously taken into account for determining market price in respect of lands covered under the second notification. This ground has been specifically taken as ground 'O' in the Special Leave Petition filed by the State which reads as thus:-

From the perusal of both the charts it is evident that the sale deeds relied upon by the land owners are altogether different from the Sale Deeds as mentioned by the Hon'ble High Court in para-21. It appears that the Hon'ble High Court considered the sale deeds in regard to the first batch of notification and no Sale Deeds except mentioned at Sr.No.5 of the Award passed by Ld. Additional District Judge, was considered by the Hon'ble High Court and fixed the market value on the basis of sale deeds not pertaining to the notification of present case.
In view of this the impugned order is liable to be set aside."
In other words, the ground urged is that the High Court
has committed an error apparent on the face of the record. Land owners submit that the per acre market price fixed by the High Court in respect of the second notification dated 26.03.2008 is inadequate and should be same as fixed for the first notification dated 10.07.2007. Hence, we dispose of the appeal(s) filed by the State against enhancement as well as the appeal(s) filed by the claimants/land owners for further enhancement, with liberty to both parties to first move the High Court by way of review petition(s) and if that decision is adverse, they may challenge the said decision in review as well as the impugned judgment by way of fresh special leave petition(s). The claimants/land owners may file review petition regarding the market price and the quantum of deduction towards development, as ordered in respect of lands covered under the first notification. We give liberty even to the claimants/land owners to file fresh special leave petition(s) or to get their present special leave petition(s) revived, which are being disposed of in terms of this order, by filing a formal application, if no additional grounds are to be urged against the order in review.
Accordingly, the appeal(s) filed by the claimants as well as by the State concerning the second notification are disposed of with liberty to both sides to approach the High Court by way of review petition(s) in the first instance and
then to this Court, if necessary.
Needless to observe that the High Court may condone the delay in filing the review petition(s), if filed within four weeks from today and hear the review petition(s) on merits, expeditiously.
Pending applications, if any, also stand disposed of.
