The matter above mentioned was listed before the Hon'ble Court on 26.09.2016, when the Court was pleased to pass the following order:-

"The issue raised by the learned counsel for the petitioner is whether the multiplier in this case where the deceased was a bachelor should be chosen as per age of the deceased or that of the dependent.

Delay condoned. Issue notice.

If the entire amount awarded by the Courts below has not been deposited so far, then the petitioner will not be coerced to pay the entire amount if the petitioner deposits an amount of Rs. 45,00,000/- (Rupees forty five lakhs) before the Tribunal within six weeks. The claimants shall be permitted to withdraw the same."

It is submitted that pursuant to aforesaid order show cause notice to Respondent Nos. 1 to 5 was issued on 08.10.2016 by registered AD. As per India Post tracking report notice has been delivered to Respondent Nos. 1 to 3 and not delivered to Respondent Nos. 4 & 5.

Service is not complete on Respondent Nos. 4 & 5.

The matter above mentioned is listed before the Ld. Registrar Court with this Office Report.
