WP(C) 805/15 3 UPON hearing the counsel the Court made the following O R D E R Mr. Sabu Steephen, the petitioner appearing in-person has submitted that his prayer (b) in the writ petition should be adjudicated first. The said prayer reads as under:- ⬠S Issue a writ of certiorari or direction or order or any other writ thereby quashing Animal Birth Control (Dogs) Rules, 2001 being ultra vires to/ violative of Sections 11(3)(b) and (c) and 38(2) (ea) of the Prevention of Cruelty to Animals Act, 1960 and violative of Article 19 and 21 of the Constitution of India.⬠\235 The petitioner in-person has filed certain interlocutory applications and he wants to modify the same. He is permitted to file fresh interlocutory applications taking additional grounds challenging the manner in which the Gazette Notification is issued. He may do so within two weeks hence. Counter affidavit in this regard, if not filed, be filed within four weeks hence. It is submitted by Mr. Gaurav Agarwal, learned counsel appearing for Justice Sri Jagan Committee that about 400 applications were received by the Committee, out of which twenty-four have already been dealt with. At this juncture, Mr. V.K. Biju, learned counsel appearing for one of the affected parties, that is, Jose Sebestian, has submitted that his matter is pending before the Committee.
