It is submitted that S.K. Sabharwal, Advocate for Respondent No. 4 has filed an application for substitution to bring on record the LRs of deceased Respondent No. 4 alongwith application for condonation of delay in filing substitution application. The applications (I.A Nos. 3 and 4) were listed before the Hon'ble Court (In Chambers) on 13.01.2014, when the Court was pleased to pass the following order:-

" Issue notice on the application for condonation of delay in filing application for substitution as well as on the application for substitution, returnable in six weeks."

It is further submitted that show cause notice was issued on 18.02.2014 to both the petitioners through Dr. Kailash Chand, Advocate for petitioners but no reply has been filed so far. The applications (I.A Nos. 3 & 4) were again listed listed before the Hon'ble Court (In Chambers) on 31.03.2014, when the court was pleased to pass the following order:-

" Perused the Office Report on Default. At the request of learned counsel for the petitioners, one week's time is granted

for filing the application for setting aside abatement."

It is submitted that Dr. Kailash Chand, Counsel for the petitioner has filed an application for setting aside abatement and condonation of delay in filing substitution application as there was a delay of 349 days in filing the substitution application which are registered as I.A Nos. 5 & 6 and included in the Paper Books.

The applications above-mentioned are listed before Hon'ble Court (In Chambers) with this office report.
