UPON hearing counsel the Court made the following O R D E R SLP(C) NO.34043/2011 Matter falls under complete category. However, further necessary orders would be passed as and when other connected matter would become ready. -2- Item No.11 SLP(C) NO.3403/2012 As reflected from the office report on 31.3.2014, the matter was listed before the Hon'ble Judge in Chambers when His Lordship was pleased to pass the following directions
" Perused the Office Report on Default. At the request of learned counsel for the petitioners, one week's time is granted for filing the application for setting aside abatement."
As per the above noted direction, the ld. Counsel for the petitioner was supposed to move an application for setting aside abatement in respect of respondent No.4 but it seems that instead only an application for condonation of delay has been filed. The ld. counsel for the petitioner to rectify the omission within two weeks and on compliance applications be processed as per rules. In the event of default matter be placed before the Hon'ble Judge in Chambers for necessary orders/directions.
So far as remaining respondents are concerned, service is complete and duly represented respondents have already filed counter affidavit on record.
List again on 9.5.2014.
