OFFICE REPORT

The Special Leave Petition above mentioned has been filed against the final Judgments and Orders dated 29.10.2015 & 22.01.2016 passed by the High Court of Madhya Pradesh, Principal Seat at Jabalpur in WP No. 553/1997 & MCC No. 121/2016 respectively.

It is submitted that Petitioner No. 20 in MCC No. 121/16 was party before the High Court in WP No. 553/97.

It is submitted that there is a delay of 86 days in refiling the special leave petition the same and counsel for the petitioner has also filed application in support, thereof.

It is submitted that Mr. Divyakant Lahoti, Advocate has filed a letter dated 19.05.2016. Copy of letter dated 19.05.2016 has been placed at page no. 100 of SLP paper books.

It is further submitted that Special Leave Petition (C) No. 6855 of 2016 arising out of same judgment was listed before the Hon'ble Court on 18.03.2016 and 01.07.2016 when the Court was pleased to direct issue of notice and the same is still pending before the Hon'ble Court. Copy of order dated 18.03.2016 & 01.07.2016 has been annexed as annexures P-7 at page no. 95 of SLP paper books and P-13 at page no. 13 in paper books of I.A. (application for additional documents).

It is further submitted that counsel for the petitioners has on 31.05.2016 filed translated true copy of order dated 13.05.1996 in terms of undertaking dated 23.05.2014 and the same has been included in the SLP paper books.

It is also submitted that counsel for the petitioners has on 08.06.2016 filed proof of service to the caveator, however the name of the caveator has been deleted in this matter.

It is lastly submitted that counsel for the petitioners has on 05.07.2016 filed application for permission to bring on record additional documents and facts along with Annexures P-9 to P-11 but counsel has not filed application for exemption from filing official translation. As the matter is on board, the same are being circulated with this office report.

The matter above mentioned is listed before the Hon'ble Court with this Office Report.
