It is further submitted that in SLP (C) No. 17615 of 2008 Entitle Subhash Chander & Ors. Versus State of Haryana & Anr. arising out of similar issue, while granting leave, appeal (Civil Appeal No. 2187 of 2013) was disposed of on 19.02.2013 by Hon'ble Mr. Justice H.L. Dattu and Hon'ble Mr. Justice Dipak Misra. (Copy of order dated 19.02.2013 is annexed as Annexure P-3 at page nos. 39-47 in the paper books).

The matter is listed before the Hon'ble Court with this office report.
