UPON hearing the counsel the Court made the following O R D E R
Issue notice.
Mr. B. K. Prasad, learned counsel, has put in appearance on behalf of the Union of India. Ms. Gargi Khanna, learned counsel, appears for respondent No. 1 in SLP (C) No. 26426 of 2016.
Let notice be served on the other unserved respondents. Dasti service, in addition, is permitted.
Counter affidavits, if any, be filed within six weeks.
Rejoinder affidavits may be filed within two weeks thereafter.
Replies shall also be filed to applications seeking to urge additional grounds in the special leave petitions, to application seeking to file additional documents as well as to other Interlocutory Applications.
We may record that Mr. Mukul Rohatgi, learned Attorney General, has made a fervent plea that these special leave petitions filed by the Government of National Capital Territory of Delhi are not maintainable. He has also argued that affidavit in support of the petition is sworn in by the Deputy Chief Minister who is not competent to file this affidavit and the affidavit of Secretary should have been filed. These aspects shall be considered at the time of hearing.
