UPON hearing counsel the Court made the following O R D E R

Order to issue notice dated 2.4.2009 is not complied with till date.

Notices could not be confirmed upon all the respondents because of improper address and because of nonpayment of process fee on several occasions by the petitioners. Repeatedly time was granted to pay process fee and to supply spare copies, initially on 18.9.2009, as last chance and again on 19.1.2010, 12.3.2010 and 12.5.2010. On 12.5.2010, there was specific order that if process fee is not Item No.31 -2-

paid before 14.5.2010, the matter is to be listed before the Hon'ble Judge in Chambers for non-prosecution and if process fee is paid, then Registry was directed to comply with the earlier order.

The learned counsel for the petitioners seeks further four weeks' time for payment of process fee.

Registry has to clarify to the undersigned within a week that why order dated 12.5.2010 was not complied with so far to list the matter before the Hon'ble Judge in Chambers for non-prosecution, in view of non-payment of process fee by the petitioners on or before 14.5.2010.

On enquiry, it is being reported that even cause title is not amended by the petitioner, as per order dated 12.5.2010.

List before the Hon'ble Judge in Chambers for nonprosecution.
