The matters above mentioned were listed before the Hon'ble Court on 03.11.2014 with office report dated 31.10.2014, when the Court was pleased to pass the following order:-

"Impleadment application is allowed.

Mr. H.D. Thanvi, learned counsel, has submitted that he has instruction to appear for Respondent No.3 and has prayed for some time to file vakalatnama and counter affidavit.

He may file vakalatnama within one week and counter affidavit within three weeks from today. The other served respondents may also file their counter affidavit within three weeks from today.

List the matters on 17th December, 2014."

It is submitted that pursuant to aforesaid order the applicant in impleadment application has been arrayed as party Respondent No.5 in these SLPs and Cause Title has been amended in SLP Paper Books.

It is further submitted that Mr. H. D.Thanvi, Advocate has neither filed Vakalatnama/Appearance nor Counter Affidavit on behalf of Respondent No. 4 so far. No one has entered appearance on behalf of Respondent Nos. 1, 2 and 4 though served with notice.

Service is already complete but no one has entered appearance on behalf of respondents.

The matter above mentioned was listed before the Hon'ble Court on 03.11.2014, when the Court was pleased to pass the following order:-

"Permission to file SLP is granted.

Issue notice. Mr. H.D. Thanvi and Mr. Mukesh Giri, learned counsel, appearing for the respondents waive notice and seek time to file vakalatnama and counter affidavit.

They may file their vakalatnama within one week and counter affidavit within three weeks from today. Rejoinder affidavit, if any, may be filed within three weeks thereafter.

List the matter on 17th December, 2014, along with SLP(C)Nos.23955-23956 of 2014."

It is submitted that show cause notice returnable for 17.12.2014 to all the 4 Respondents was issued on 21.11.2014 by registered AD. Mr. H.D. Thanvi, Advocate and Mr. Mukesh Giri, Advocate have not filed Vakalatnama/Appearance on behalf of Respondents so far. Neither AD nor unserved cover has been received so far.

Service is not complete.
