We have heard Mr. Jayant Bhatt, learned counsel appearing for the appellant – State of Rajasthan and learned counsel appearing for the respondents.

We do not find that there is any reason to interfere with the impugned order dated 15-9-2006 so passed by the High Court of Rajasthan at Jaipur. There is no merit in the Appeals filed by the State of Rajasthan. Hence, the Criminal Appeals are dismissed.

However, we must express our gratitude to Mr. R.S. Hegde, learned Amicus Curiae who was appearing on behalf of sole respondent in Criminal Appeal No.1850 of 2008 and helped us to come to such a conclusion.
