UPON hearing the counsel the Court made the following O R D E R

C.A. No. 3332/2014

Delay in filing the substitution of Lrs. of deceased petitioner No. 3 and setting aside abatement is condoned.

I.A. No. 196219/2024 : Prayer made in this application is to bring on record the Lrs. of petitioner no. 3 (Harbhajan Kaur) who has passed away on 08.07.2023. The details of the legal representatives have been given in paragraph 2 of the application. Out of which person at serial no. 3 has also expired on 01.10.2023 leaving behind his legal representatives as detailed in paragraph 3 of the application.

Learned counsel for respondent no. 1 states that he has no objection to the prayer made in this application.

In the light of the above, the present application is allowed and legal representatives as mentioned in paragraphs 2 and 3 of the application are to be brought on record.

Amended memo of parties be filed within two weeks.

I.A. No. 196220/2024: Abatement is set aside.

Delay in filing the substitution of Lrs. of deceased respondent No. 5 and setting aside abatement is condoned.

I.A. No. 149468/2024 : Prayer made in this application is to bring on record the Lrs. of respondent no. 5 (Kalawati) who has passed away on 31.12.2023 leaving behind her legal representatives i.e. husband and two sons but husband of deceased respondent no. 5 is already sole petitioner and, therefore, persons mentioned at serial nos. 2 and 3 have to be brought on record. The application is supported by the affidavit.

In the light of the above, the present application is allowed. Subject to just exception, the legal representatives as mentioned in paragraphs 2 of the application are to be brought on record.

Amended memo of parties be filed within two weeks. I.A. No. 162829/2024: Abatement is set aside.
