Heard the learned counsel for the petitioner and

perused the relevant material.

Exemption from filing certified copy of the

impugned order and O.T. is granted.

Issue notice, returnable in two weeks.

Dasti, in addition, is permitted.

Liberty is also granted to serve the notice through the learned Standing Counsel of the State of Maharashtra.

Learned counsel for the petitioner is not in a position to apprise the Court as to how immediate is the need for the surgical procedure advised for the petitioner. However, having regard to the prayer for interim relief we direct that the operation of the order of the High Court dated 4th September, 2017 passed in Criminal Application No.646 of 2017 in Criminal Appeal No.1012 of 2013 shall remain stayed for a period of two weeks.
