The matter above mentioned was listed before the Ld. Registrar's Court on 15th December, 2016 when the Court was pleased to pass the following Order:

"Service is awaited in respect of the respondents. However, Mr.Sunil Fernandes, Ld.counsel undertakes to appear for the respondent No.1. He seeks and is given one week's time to file the vakalatnama and four weeks time to file the counter affidavit. Ld.counsel for the petitioner is directed to serve the copy of pleading to the said respondent within one week after filing the vakalatnama.

Ld.counsel for the petitioner has stated that she has filed an application for deletion of respondent Nos.2 & 3. Office shall verify the position. If the same is filed and if it is in order, the same shall be processed for listing before the Hon'ble Judge in Chambers for further directions."

It is submitted that Mr. Sunil Fernandes, Advocate though appeared on behalf of Respondent No. 1 but has not filed Vakalatnama and Memo of appearance on his behalf so far. Hence no Counter Affidavit.

It is further submitted that the names of Respondent Nos. 2 and 3 have been deleted from array of parties vide Order dated 27th January, 2017 passed in Interlocutory Application No. 2 of 2016. The Cause title has been amended and included in the paper books.

Notice to respondent no. 1 has been issued on 6th February, 2017 and office copy is still awaited.

The matter above mentioned is listed before the Ld. Registrar's Court with this Office Report.
