We are not inclined to interfere with the impugned judgment, as it has been dealt with on facts.

In such view of the matter, the question of law which has been raised is left open.

However, the fair statement and concession made by Mr. V. Giri, learned senior counsel appearing for the respondent, that the respondent will not seek refund of the liquidated damages which has already been deducted by the petitioner stands recorded.

The appeal is disposed of accordingly.
