Having heard learned counsel for the parties, it is directed that the Medical Council of India shall send a team for inspection as per the schedule for the academic year 2018-19. The application that has been filed by the institution for the academic year 2017-18 shall be treated as an application for the academic year 2018-19. The deficiencies noted by the Inspection Committee shall be brought to the notice of the institution, and it shall be granted liberty to remove the deficiencies. Thereafter, the matter shall be placed before the Hearing Committee, if required, after removal of deficiencies, and if any deficiency is still required to be removed, the same shall be removed by the institution, and if the institution is a compliant institution, it shall get the Letter of Permission for the relevant academic year i.e. 2018-19.
Mr.Gaurav Sharma, learned counsel would submit that the petitioners are required to pay the inspection fee, if it not paid for the inspection to be conducted for the academic session 2018-19.
Mr.Gaurav Bhatia, learned counsel for the petitioner, who initially opposed the prayer eventually agreed that the institution shall pay the fees for the fresh inspection.
The writ petitions and I.As stand disposed of in the above terms. No costs.
