UPON hearing the counsel the Court made the following O R D E R

Heard Mr. Tushar Mehta, learned Additional Solicitor General alongwith Mr. Gurmeet Singh Makkar appearing on behalf of the petitioner-Union of India, Mr. Shekhar Naphade, learned senior counsel alongwith Mr. Abhay Anturkar, learned Advocate-on-Record Mr. C.U. Singh, learned senior counsel on behalf of M/s. Karanjawala & Co. and Mr. Vinay Navare, learned counsel alongwith Ms. Abha R. Sharma, learned Advocate-on-Record for the respective respondents.

During the course of hearing it was suggested by both the parties that the writ petition pending before the High Court be transferred to this Court so that the controversy can be put to rest. We appreciate the fair suggestion made by the Bar and accordingly we transfer the PIL (Stamp) No.24110/2017 and W.P.No.9508/2017 before this Court. However, we are obliged to clarify that transfer of the writ petition to this Court should not be construed as any reflection on the Bench of the High Court. We repeat that we have transferred the case on consent having regard to convenience.

The Registry is directed to do the needful in the matter. After the matter is transferred to this Court, it should be

registered as a Transferred Case and be listed alongwith the special leave petition for final disposal on 30th November, 2017. All the parties are granted liberty to file their affidavits so that the hearing of the case is not delayed.
