After having gone through the impugned judgment dated 24.08.2004 passed by the Gauhati High Court in Second Appeal No. 86 of 1998 and having perused the record, we are of the

opinion that there is no infirmity in the impugned judgment and hence it does not call for our interference.

Having no merit the Appeal stands dismissed. No costs.
