As the respondent No.2 - complainant is represented, who is on caveat, we are of the view that no useful purpose will be served by keeping the present Special Leave Petition pending. 4. Leave granted. 5. Having regard to the totality of the facts of the case, we set aside the order of the High Court and request the High Court to decide the case on merits after hearing the learned counsels for the accused as well as the complainant. The High Court is also requested to decide the matter as expeditiously as possible. It is made clear that we have expressed no opinion on merits.
