The matters above mentioned were listed before the Hon'ble Court on 24th November, 2014 when the Court was pleased to pass the following Order:

"Respondent No. 1, who had expired in the High Court, was substituted and the legal representatives were brought on record as Respondent Nos. 1.1 to 1.7. The said respondents have been arrayed as Respondent Nos. 1 to 7 before this Court. Mr. Nagendra Rai, learned senior counsel along with Mr. Jay Kishor Singh have entered appearance on behalf of the said respondents. Hence, no notice needs to be served.

Mr. O.P. Bhadani has entered appearance on behalf of Respondent No. 9 and Mr. Subramonium Prasad, learned counsel has already entered appearance on behalf of Respondent No.10.

As far as Respondent No. 8 is concerned, an application for substitution and condonation of delay has been filed. One of the legal heirs, i.e.,Respondent No. 8.4 has entered appearance through Mr. Mukesh Giri.

In view of the same, notice be issued to other legal heirs of Respondent No. 8 on the application for substitution as well as

on the application for condonation of delay returnable in four weeks. List the matter after six weeks."

It is submitted for the information of the Hon'ble Court that there are ten Respondents in the matters above mentioned. Respondent Nos. 1 to 7 are represented by Mr. Jay Kishor Singh, Advocate but no counter affidavit has been filed so far. Respondent No. 8 i.e. Mr. Kanti Lal Ambalal Patel has expired (original position Respondent No. 2 in SLP (C) No. 2737727379 of 2014) and counsel for the petitioner has filed an application for substitution of LRs of said deceased Respondent which is barred by time by 137 days and counsel for the petitioner has filed an application for condonation of delay in filing the said applications. The applications have been registered as Interlocutory applications Nos. 1115 and 1620 respectively and have already been included in the paper books. All the proposed Legal representatives are represented by Mr. Mukesh Kumar Giri, Advocate. Respondent No. 9 is represented by Mr. O. P. Bhadani, Advocate and he has filed counter affidavit which has already been included in the paper books and Respondent No. 10 is represented by Mr. Subramonium Prasad, Advocate and he has also filed counter affidavit on behalf of said respondent which has been included in the paper books. Counsel for the petitioner has filed rejoinder affidavit and the same has been included in the paper books.

Service of notice is complete in the SLP as well as in applications.

The matters along with applications above mentioned are listed before the Hon'ble Court with this report.
