Ld.counsel for the appellant shall file the affidavit of valuation within a period of four weeks.

The sole respondent has not filed the counter affidavit in spite of last chance granted. Viewed thus, the matter shall be processed for listing before the Hon'ble Court as per rules.

The office report is that the Ld.counsel for the respondent No.1 has already filed the counter affidavait.

Ms.Diksha Rai, Ld.counsel shall file the NOC from the erstwhile counsel Mr.Siddhartha Choudhary within a period of two weeks time as last chance.

SLP(C) No.38608/2012

Fresh steps for the service of notice by usual mode to the unserved respondent No.2 shall be taken by the Ld.counsel for the petitioner within a period of three weeks.

SLP(C) No.38609/2012

Ld.counsel for the respondent No.1 has already filed the counter affidavait but he has failed to file the vakalatnama. Ld.counsel shall within a period of four weeks file the vakalatnama failing which the counter affidavait filed by him shall be taken off the record.

Fresh steps for the service of notice by usual mode to the unserved respondent No.2 shall be taken by the Ld.counsel for the petitioner within a period of three weeks.

List the matter again on 27.11.2015."

It is submitted that Counsel for the petitioner has neither take fresh steps to serve the unserved Respondent No. 2 nor filed spare copy to issue notice to Respondent No. 2.

It is further submitted that Ms. Diksha Rai, Counsel for the petitioner has not filed NOC from erstwhile Counsel Mr. Siddhartha Choudhary so far.

SLP(C) NO. 38608 OF 2012

It is submitted that Counsel for the petitioner has not taken any fresh steps to serve the unserved Respondent No. 2 so far.

It is further submitted that Mr. Nachiketa Joshi, Counsel for the Respondent 1 has not filed Counter Affidavit so far.

SLP(C) NO. 38609 OF 2012

It is submitted that Mr. Kunal Verma, Advocate has filed Vakalatnama on behalf of Respondent 1 and he has already filed Counter Affidavit.

It is further submitted that counsel for petitioner has not taken any steps to serve the unserved Respondent2 so far.
