It is submitted that an application for extension of time for deposit the amount and modification of this Court's order dated 14.03.2014 (Criminal Miscellaneous Petition Nos. 20231 & 20232 of 2014 respectively) in application for exemption from surrendering (Criminal Miscellaneous Petition No. 17346 of 2014) was listed before the Hon'ble Judge-in-Chambers on 13.11.2014, when his Lordship was pleased to pass the following order:
"Heard learned counsel appearing for both the petitioner and Respondent No.1-Complainant.
Earlier, by order dated 01.09.2014, the petitioner was granted exemption from surrendering subject to depositing of a sum of Rs.7,00,000/- (Rupees seven lakhs) with the Registry of this Court within four weeks. The petitioner has not deposited the requisite amount within the stipulated period. Before the expiry of that time, the petitioner filed an application for modification /relaxation on the ground that steps were being taken for compounding of the offence with respondent no.1/Complainant.
Counsel claims that on 07.11.2014, the petitioner has filed an application seeking permission for compounding of the criminal complaint along with joint memo of compounding (compromise).
In the aforesaid facts, the order dated 01.09.2014 is recalled. The special leave petition stands restored to its original number. In view of claim of compounding, petitioner is granted exemption from surrendering.
Place the matter before Bench."
It is submitted that Counsel for the petitioner has on 7.11.2014 filed an application for permission for compounding of criminal complaint along-with joint memo of compounding (compromise). The same has been registered as Criminal Miscellaneous Petition Nos. 23342 Of 2014.(Copy of the same has been included in SLP Paper Books.
It is submitted that there is a delay of 46 days in filing the Special Leave Petition and counsel for the petitioner has filed an application for condonation of delay in filing the same.
The matter above mentioned is listed before the Hon'ble Court with this office report.
