The application has been filed seeking to withdraw the Civil Appeal No.1531/2011 to avail of the benefit of a Scheme of the Government of Odisha as a One Time Settlement of arrears of electricity dues and interest dated 30.11.2022.
Learned counsel for the applicant points out that the case of the applicant would fall within the category-I(v).
The aforesaid position is not disputed by learned counsel for the State.
In view thereof, certain directions are sought and we thus, dispose of the application in the following terms:
(1) The appeal shall stand dismissed as withdrawn;
(2) The case of the appellant/applicant will be considered under the Scheme dated 30.11.2022; (3) In order to meet the requirements of sub-
clause (v) of category-I, the amount deposited by the the appellant in the State Bank of India, Bhubaneswar along with accrued interest would be released to the applicant and simultaneously thereafter the principal with interest along with TDS will be transmitted to the treasury account. This is so that the same is in terms of the OTS Scheme.
On the aforesaid being completed, the escrow account be closed by the Bank which is stated to have been opened as per the directions of the Court.
The application is allowed in the aforesaid terms.

The application is allowed and the appeal is dismissed as withdrawn in terms of the signed order.
REST OF THE MATTERS
Mr. Amit Pai, learned counsel submits that still some of the parties have not given their written synopsis or the list of judgments as a result of which the compilation has not been filed.
He however, submits that in order to facilitate hearing, deadline may be fixed whereafter it should be presumed that the remaining parties are not interested in supplementing the synopsis/judgments as may be filed by others and their right to file so would stand closed.
We agree with the aforesaid and grant time till
the end of this month for the parties to do whatever they deem proper where after the compilation will be filed. Compilation to be filed by 14th April, 2023.
List on 18th April, 2023 for directions in the miscellaneous matters to ensure that the house keeping task is over so that the matters can be set down for hearing immediately thereafter.
