Ms. Anshula Vijay Kumar Grover, AOR UPON hearing the counsel the Court made the following O R D E R Learned counsel for the petitioner refers to the
affidavit filed by him in pursuance to our order dated 09.04.2021 to submit that Annexure P-1 gives the list of the properties. It is his say that at the moment, partition of properties at serial Nos.1, 2 and 4 is in progress and property Nos.5 to 7 are not in the inventory. Property Nos.5 and 6 form a part of the gift deed. It is his say that property Nos.5 to 7 can be put in the inventory and in property Nos.5 and 6 the petitioners are willing to take 1/18th share instead of 1/9th share, apart from the properties at serial Nos.1, 2 and 3.
In compensation of the same, they seek property No.4 to be left to the petitioners.
Learned counsel for the respondent states that since he appears only for respondent No.12, the other parties will have to be before the Court for an endeavour to work this out.
Respondent Nos.3 and 4 are stated to be the legal heirs of the original donee as far as the gift is concerned.
Issue notice to the respondents returnable in four weeks.
A copy of the order dated 09.04.2021 and the order passed today to accompany the notice.
