We have heard learned counsel for the parties.
Being aggrieved by the refusal of grant of bail, the petitioner has preferred this special leave petition.
The petitioner is said to have been involved in the case, Crime NO.58 of 2017, under Sections 399 and 402 I.P.C. and Sections 27 and 30 of the Arms Act. In the Crime No.58 of 2017, the occurrence is alleged to have taken place on 19th February, 2017, on which date, the petitioner was admittedly in custody in connection with Crime No.42 of 2017. between the petitioner and the co-accused, at this stage we are not inclined to go into the merits of the said contention.
Considering the fact that the petitioner-Sunil Kumar @ Silent Sunil was in custody at the relevant point of time, he is granted bail in Crime NO.58 of 2017 subject to the satisfaction of the trial court. The trial court will be at liberty to impose such terms and conditions as it may deem necessary.
The special leave petition is accordingly disposed of.
Pending applications, if any, shall also stand disposed of.
