UPON hearing the counsel the Court made the following O R D E R

SLP(C) No. 11737/2024

Four weeks time, as last chance is granted to the respondent Nos. 1, 2, 4 and 11 to 17 to file counter affidavit.

It has been submitted by Ld. Counsel for respondent No.7 that he has entered appearance on behalf of Respondent Nos. 7 to 10, while it is wrongly mentioned in the office report that he has entered appearance only on behalf of Respondent No. 7. Registry to verify the same. If so, four weeks time is granted to Respondent Nos. 7 to 10 to file counter affidavit.

Ld. Counsel for petitioners seeks and is granted four week's time to file affidavit of dasti service in respect of Respondent No.6.

Service of notice is complete on remaining respondents but no one has entered appearance on their behalf.

List again on 8.11.2024.

Four weeks time, as last chance is granted to the respondent Nos. 1 to 9 to file counter affidavit.

Service is complete on respondent No. 10. Ms. Gowrishankar Rajappa, Ld. Counsel submits that Mr. S. Rajappa, Ld. Counsel has already filed the vakalatnama on behalf of Respondent No. 10. Registry to verify. If so, four weeks time is granted to file counter affidavit.

Service of notice is complete on remaining respondents but no one has entered appearance on their behalf.

At this stage, Ld. Counsel for petitioners submits that Respondent Nos. 15 to 44 are proforma respondents and he will move application for deletion in respect of said respondents within a period of two weeks. Allowed.

Ld. Counsel for petitioner seeks and is granted four week's time, as last chance to file affidavit of dasti service in respect of Respondent Nos. 23, 25, 35 and 36.

List again on 8.11.2024.

Ld. Counsel for petitioners submits that he has already filed application for deletion of 28 respondents. Registry to verify and update the records.

Petitioner has failed to file spare copies for issuance of notice to the respondent Nos. 1 to 35.

However, as prayed two day's' time is granted as a last chance to the petitioner, for the said purpose.

If spare copies are filed, Registry to issue notice to the respondent and list again on 8.11.2024.

In case of default, process the matter for listing before the Hon'ble Judge-in-Chambers, for further directions.
