UPON hearing the counsel the Court made the following O R D E R

I.A. No. 40397/2024, I.A.No. 39772/2024 & I.A. NO. 40383/2024:

Heard learned counsel appearing for the parties. There is an order passed by this Court while granting leave on 26.07.2022 which reads thus:

"Leave granted.

Hearing expedited.

In the meantime, the employees shall be paid minimum pay-scale of regularly appointed employees without prejudice to the rights of the parties."

The concerned employees are still working with the University. Therefore, they are entitled to Dearness Allowance (D.A.) admissible to the pay scale mentioned in the order dated 26.07.2022. Accordingly, We modify the interim order dated 26.07.2022 by directing the University of Mumbai to pay D.A. admissible to the pay scale mentioned in the order. The D.A. shall regularly be paid to the employees from the month of June, 2024. The arrears payable till 31st May, 2024 shall be paid within six months.

It is made clear that the interim order, as modified by this order, shall be without prejudice of rights and contentions of the parties and subject to the final outcome of the Civil Appeal. We also clarify that benefit of this order will be available only to

those employees to whom the benefit of the interim order dated 26th July, 2022 is available.

All three above applications are accordingly disposed of.

Considering the controversy involved, we direct that the appeal shall be listed for final hearing on 23rd October, 2024.

Needless to clarify that the appeal will be taken up only if the larger Bench decides the pending issue.

The Contempt petition Nos. 810-811/2023, 812-813/2023 and 814- 815/2023 stand disposed of.
