The SLP(C) No. 28285 of 2016 was listed before the Ld. Registrar's Court on
30th November, 2015, when the following inter-alia order was passed :
"SLP(C) No. 28285/2015
Ms. Tanvi Kakar, Advocate, has appeared on behalf of the respondent nos.1 to 4. She seeks and is given two weeks time to file the Vakalatnama and four weeks time, thereafter, to file the counter affidavit. Await the return of the service of notice already issued to the respondent no.5. I.A. for impleadment shall be processed for listing before the Hon'ble Judge-in-Chambers. "
Subsequently, the Interlocutory Application No. 3 (Application for Impleadment) was listed before the Hon'ble Court (In Chambers) on 31st March, 2016, when the Hon'ble Court was pleased to pass the following order :
"Let IA No. 3/2016 be listed for orders at the time of hearing of the special leave petition.
In the meanwhile, learned counsel for the petitioners is at liberty to file reply to the application."
It is submitted that there 5 Respondents in the matter. Ms. Suchitra A. Chitale, Advocate has filed vakalatnama/appearance on behalf of Respondent No. 1 to 4 but not filed counter affidavit. A period of more than thirty days NS
elapsed but neither AD card nor unserved registered cover has been received back from Respondent No. 5.
Service is not complete on Respondent No. 5.
SLP(C) No. 32038 of 2015
The matter above-mentioned was listed before the Ld. Registrar's Court on 12th May, 2016, when the following order waspassed :
"The office report indicates that the Ld. Counsel for the respondent Nos. 5 to 8 have failed to file the counter affidavit within the period stipulated under the rules. Service of notice is complete on the respondent No. 4 but no one has entered appearance on his behalf.
Fresh steps for the service of notice by usual mode to the respondent Nos. 1 to 3 shall be taken by the learned counsel for the petitioner within a period of four weeks.
List again on 4.8.2016."
It is submitted that there are 8 Respondents in the matter. Ms. Suchitra A. Chitale, Advocate has entered appearance on behalf of Respondent Nos. 5 to 8 but has not filed counter-affidavit so far. Service is complete on Respondent No. 4 through AD card but no one has entered appearance on his behalf so far.
It is further submitted that Counsel has not taken fresh steps for effecting service on Respondent Nos. 1 to 3 so far. Hence, Show cause notice could not be issued.
Service is not complete on Respondent Nos. 1 to 3.
The aforesaid matters alongwith application are listed before the Ld. Registrar's Court with this office report.
