The matter above-mentioned was listed before the Ld. Registrar's Court on 11th November, 2013, when the following order was passed:-
"Respondent Nos. 1,5,10,12,13,23,25-38, 43-45, 49,52,54-56,60,63 are granted six weeks time as final chance for filing counter affidavit.
Respondent Nos. 2,4,6, 7,15, 19,22, 24,40-42, 46-48, 50,57-59 and 61 are reported to be duly served but none appeared nor any steps taken on their behalf.
Respondent no.11 is reported to have expired. The ld. Counsel for the petitioner to take steps for substitution of his legal representatives within four weeks and on compliance same be processed as per rules.
Notices be re issued to respondent Nos. 3,8,17,18,20,39 and 51 through the concerned District Court in addition to usual mode.
On furnishing the fresh complete addresses of respondent Nos. 9,14,16,21,53 and 62, notices be re issued through the concerned District Court in addition to usual mode.
Registry to rectify the data base as regards the name of the ld. Counsels, Mr L.K.Pandey and Mr Shakun Sharma.
List again on 9.7.2014."
Pursuant to above quoted order none of the Advocate for respondents has filed counter affidavit so far.
It is submitted that Mr. B. Balaji, Advocate has not filed application for substitution of bringing on record the legal representatives of deceased respondent No. 11 so far.
It is further submitted that show cause notice could not be issued through concerned District Court to respondent Nos. 3, 17, 18, and 20 as Mr. B. Balaji, Advocate has not filed process fee and spare copies for effecting service on the above mentioned respondents.
It is lastly submitted that the counsel for the petitioner has not furnished complete and correct addresses, process fee and spare copies in respect of respondent of Respondent Nos. 9, 14, 16, 21 and 53.
Duly signed A.D. cards have been received in respect of respondent No. 8, 39, 51 and 63. Now, Service of notice is incomplete on respondent Nos. 3, 9, 11, 14, 16 to 18, 20, 21, 51 and 53.
The matter above-mentioned is listed before the Ld. Registrar's Court with this office report.
