PETITION FOR SPECIAL LEAVE TO APPEAL(CIVIL) NO. 35520 OF 2013

The matter above-mentioned was listed before the Ld. Registrar's Court on 29th February, 2016, when the following order was passed:-

"Two weeks time is granted as last opportunity to the Learned Counsel for the petitioners to take fresh steps for effecting service on Respondent Nos. 17, 18, 20 and 21. Notice thereafter, be issued.

Registry to mention status of remaining respondents in the next office report

List again on 11.05.2016."

It is submitted that there are sixty three respondents. Respondent Nos. 1, 10, 12, 25 to 37, 43 to 45, 49, 52, 54 to 56, 60 and 63 are represented by Mr. Shakun Sharma, Advocate and he has filed counter affidavit on their behalf. Respondent Nos. 5 and 23 are represented by Mr. Anil Kumar Mishra, Advocate, but he has not filed counter affidavit so far. Respondent No. 38 is represented by Mr. L. K. Pandey, Advocate, but he has not filed counter affidavit so far. A.D. cards duly singed have been received back from Respondent Nos. 2 to 4, 6 to 9, 11, 13 to 22, 24, 39, 40 to 42, 46-48, 50, 51, 53, 57 to 59, 61 and 62, but no one has entered appearance on their behalf so far.

It is further submitted that application for substitution for bringing on Lrs. of deceased Respondent No. 11 has been allowed vide Hon'ble Chamber Judge order dated 22nd February, 2016 and accordingly cause title has been amended.

It is further submitted that Counsel for the Petitioner has on 7th November, 2014 filed affidavit of service in which he has stated that he has served copy of the paper book on the Legal Representatives of deceased Respondent No.11.

Service of notice is complete.

PETITION FOR SPECIAL LEAVE TO APPEAL(CIVIL) NO. 12565 OF 2016

Thereafter, the matter above-mentioned was listed before the Hon'ble Court on 25th April, 2016, when the Court was pleased to pass the following order:-

"Delay condoned. Issue notice. Tag with SLP(C)No. 35520 of 2013."

It is submitted that pursuant to above quoted order, show cause notice was issued to sole Respondent on 6th May, 2016. Service is awaited.

The matter above-mentioned is listed before the Ld. Registrar's Court with this office report.
