The matter above mentioned has been filed on 29th January, 2016 against the common impugned final judgment and order dated 8th September, 2015 passed by the High Court of Judicature at Madras in W.A. SR No. 52462 of 2012 which is/are barred by time by 53 days and the same was/were defective. After curing the defects the Counsel has re-filed the Petition which is also barred by time by 47 days and Counsel for the Petitioner has filed an application for condonation of delay in re-filing the Special Leave Petition.

It is submitted that Special Leave Petition(C) No. 35520 of 2013 arising out of SLP CC..No. 15211 of 2012 entitled " STATE OF TAMIL NADU BY SECY. & ORS -Versus- PON ELANGOVAN & ORS."@ similar issue was listed before the Hon'ble Court on 11th November, 2013 when the Court was pleased to issue notice. Copy of the Record of proceedings dated 11th November, 2013 is circulated herewith.
