UPON hearing the counsel the Court made the following O R D E R

The acquittal of the appellant for a charge under Section 302 of IPC was set aside by the High Court. He was convicted and sentenced to undergo life imprisonment. The appellant is seeking bail on the ground that he has undergone a sentence of 8 years and that he is suffering from serious ailments. He has suffered a stroke ("Cerebrovascular Accident") due to which he is now having Paralysis ("Right sided Hemiplegia") on the right side of the body.

Mr.Shubhranshu Padhi, learned counsel appearing for the State has verified the medical condition of the appellant and submitted that the appellant is suffering from Anemia and has numbness in limbs.

Having regard to the fact that the appellant has already undergone a sentence of 8 years and that he is suffering from serious ailments, we are of the considered view that he is entitled to be released on bail.

The appellant is directed to be released on bail subject to the satisfaction of the trial court.

IA No.69792/2021 – application for grant of bail stands disposed of accordingly.
