The matter above-mentioned was mentioned before the Ld. Registrar Court on 27th March, 2015, when he was pleased to pass the following order:

"The opportunity of respondent Nos.1 to 4, 5(a), 5(b),6(a), 6(b), 6(d), 9, 16, 19, 20 and 21 to file counter affidavit has already been declined.

Service with respect to respondent Nos.6(c), 6(d), 12, 13, 22 to 24, 27 and 28 is complete but none has entered appearance.

Service of respondent Nos.10, 11, 14, 15, 17, 18, 25 and 26 and also of the legal representatives of the deceased respondent No.7 and of the deceased respondent No.8 is awaited.

List again on 7.7.2015."

It is submitted that there are 28 Respondents in the matter. Mrs. Sudha Gupta, counsel for Respondent nos. 1 to 4, 5a, 5b, 6a, 6b, 9, 16, 19, 20 and 21 has not filed counter affidavit on behalf of the said Respondents so far. No one has entered appearance on behalf of Respondent Nos. 6c, 6d, 12, 13, 22, 23, 24, 27, 28. Neither A.D. Card nor unserved cover have been received back from the Lrs. of deceased Respondent Nos. 7 and 8 i.e. Respondent Nos. 11, 14, 15, 17, 18 and Respondent Nos. 10, 11, 14, 15, 17, 18, 25 and 26.

It is further submitted that show cause notice was again issued on 5 th February, 2015 to the Counsel for the Petitioner for effecting dasti service on the Respondents with a request to file an affidavit of service alongwith proof of service on behalf of Respondent nos. 10, 11, 14, 15, 17, 18, 25, 26 and Lrs of deceased respondent no. 7 (i.e. Respondent nos. 11, 14, 15 and 17) and deceased Respondent no. 8 (i.e. Respondent no. 18) vide Ld. Registrar's Order dated 4th February, 2015.

Service is awaited.

The aforesaid matter is listed before the Ld. Registrar Court with this office report.
