UPON hearing the counsel the Court made the following O R D E R
Our attention is invited to an order dated 9th March, 2006 passed by the High Court. The High Court while dealing with the appeal against conviction filed by the appellant has recorded a prima facie finding only on the basis of ossification test that the appellant was juvenile in conflict with law on the date of the incident. It appears that the High Court did not order inquiry on the issue of juvenility through the Juvenile Justice Board.
In view of the said prima facie finding, we find it appropriate to direct the jurisdictional Juvenile Justice Board to Digitally signed by Anita Malhotra Date: 2023.12.08 17:06:14 IST Reason:

hold an inquiry on the plea of juvenility raised by the appellant. We direct the Registry to forward soft copies of the record of the Trial Court to the learned Additional Sessions Judge, Delhi, who will forward a copy of this order along with soft copies of the record to the jurisdictional Juvenile Justice Board.
The respondent-State will ensure that the appellant is traced out and served with the notice to appear before the jurisdictional Juvenile Justice Board. We grant time till the end of March, 2024, to the Juvenile Justice Board to conclude the inquiry. The report to be submitted by the Juvenile Justice Board directly to the Registry of this Court along with the evidence, if any, adduced.
List for further hearing on 10th April, 2024.
The Registry is directed to provide soft copies of the record to the learned counsel representing the parties.
