UPON hearing counsel the Court made the following O R D E R

Nobody is present for the petitioner.

There is interim stay of further proceedings since 27.9.2010. Petitioner has prayed to transfer Criminal Case No.2053/2009 before the MM, Sahibabad, Ghaziabad, UP titled as State Vs. Jhonny @ Nitin & Ors. to the Court of Delhi of competent jurisdiction. It seems that unserved respondents are shown as accused in the original case. In view of the above fact, though application for substitution filed by the petitioner on 21.12.2011 is allowed as prayed for, let there be additional notice which is to be forwarded to the Court of MM, Sahibabad, Ghaziabad, UP to confirm service upon the respondents who are accused in the Criminal case No.2053/2009 titled as State Vs. Jhonny @ Nitin & Ors. That Court can

certainly take necessary steps if respondent herein being accused were released on bail and now not available at their given address. The Court can also take steps against the

surety given by releasing such persons on bail.

Public notice be issued as prayed for.

Outcome of publication is to be disclosed on record before 21.3.2012.
