Leave granted.

Having heard learned counsel appearing for the parties and upon perusal of the record, we find that the High Court has reversed the acquittal of the appellant without hearing him on the short ground and convicted him for offences punishable under sections 279, 338 and 304(A) of the Indian Penal Code without awarding sentence.

In the circumstances, We consider it appropriate to set aside the impugned judgment of conviction passed by the High Court and remand the matter to the High Court for hearing afresh on merits.

Order accordingly.

With the aforesaid direction, the instant appeal is disposed of.
