Mr. Vikas Singh, learned senior counsel appearing on behalf of the petitioner submits that Civil Appeal No.2541/2006, in which similar issue was involved, has been referred to larger Bench by an order dated 19.1.2011 passed by a Division Bench of this Court. We are of the 2

considered view that this matter also needs to be referred to larger Bench. Leave granted. Tag with C.A. No.2541/2006. Meanwhile, there will be stay of the operation of the impugned judgment.
