OFFICE REPORT ON DEFAULT
The Transfer Petitions above mentioned were listed before the Hon'ble Judge in Chamber on 3rd October, 2016 when His Lordship was pleased to pass the following Order:
"Learned counsel for the petitioner submits that these transfer petitions have become infructuous. Learned counsel for respondents seeks time to verify the same. List the matter after two weeks."
Thereafter, the Transfer Petitions above mentioned were listed before the Hon'ble Judge in Chamber on 24th October, 2016 when His Lordship was pleased to pass the following Order:
"Learned counsel for the petitioner U.O.I. to take steps to furnish fresh address of respondent No.1 in T.P. (C) No.1691 of 2014 as noted in the office report dated 14th September, 2016 within three weeks' from today. Issue fresh notice to respondent No.1 in T.P.(C) No.1691 of 2014 on the fresh address which is to furnished by the petitioner. Dasti, in addition, is also permitted."
Pursuant to the Order quoted above, Counsel for the Respondents have not filed any document supporting/opposing the statement made by the Counsel for the Petitioner that these Transfer Petitions have become infructuous. It is submitted that certificate of service in respect of Respondent No. 1 in T.P(C) No. 1691/2014 has been received with comments "insufficient Address". Counsel for the Petitioner has not taken fresh steps for service upon R1 in T.P.(C) No. 1691 of 2014 but he has filed spare copy in form of paper books on 14th July, 2016 and same is defective. Hence notice could not be issued.
The default on part of Counsel for the Petitioner is reported before the Hon'ble
Judge in Chambers with this office report.
