In the peculiar facts of the case as no claim had been made by any other person, we are not inclined to make any interference with the impugned judgment.

However, the same is not to be treated as precedent.

The question of law is kept open.

However, the respondent shall furnish Indemnity Bond as ordered by the Trial Court.

Accordingly, the Special Leave Petition is disposed of including pending applications.
