The Transfer Petition above mentioned was mentioned before the Hon'ble Court on 12.08.2014, when

the Court was pleased to pass the following Order:-

"Taken on board. Issue notice. There shall be interim stay of further proceedings in H.M.P.Case No.95 of 2014 titled "Arpit Vs. Rohini" pending before the Court of Joint Civil Judge S.D.) at Jalna, Maharashtra, until further orders. There shall also be interim stay of further proceedings in R.C.C.No.315 of 2014 titled "Arpit Vs. Asit & Ors." pending before the Court of 3rd Joint Judicial Magistrate (F.C.), Jalna, Maharashtra, until

Accordingly, notice was issued to the Sole Respondent through Registered A.D. Post on

20.09.14.

It is submitted that neither A.D. Card nor unserved cover has been received back from the

Sole Respondent.

Thereafter the matter was listed before the Ld. Registrar Court from time to time and listed on

13.05.2015 when he was pleased to pass the following Order:

"Four weeks time as last chance is given to the Ld.counsel for the petitioner to comply with the terms of the order dated 10.03.2015 of this Court. List again on 01.09.2015."

It is submitted that Counsel for the Petitioner has on 30.07.2015 filed Application for withdrawal of Transfer Petition which has been registered as I.A. No. 2 of 2015. Copy of the same is being circulated herewith for kind perusal of the Hon'ble Court.

The matters above mentioned alongwith connected Transfer Petition(Crl.) No. 271 of 2014 was mentioned before the Hon'ble Court on 14.10.2015 when the Court was pleased to pass the following Order:

"List tomorrow,i.e. on 15th October, 2015 before Court No.1"

It is submitted that Connected Transfer Petiton (Crl.) No. 271 of 2014 has already been dismissed as withdrawn by this Hon'ble Court's Order dated 17.09.2015. Copy enclosed herewith for kind perusal of the Hon'ble Court.

Service of show cause notice is not complete.

The application for withdrawal in the matter above-mentioned is listed before the Hon'ble Court with this Office Report.
